Purchase Agreement

This purchase is being made between you ("Purchaser") and citywit.com ("CityWit, Inc." or "Seller").

Possible purchases made from citywit.com site(s), the "Seller" and you, the "Purchaser" include Subscriptions, Display Advertising and Featured Listings. The following definitions will be used when referring to the type of purchase made.

Subscriptions: The purchase of electronic access to publish information, whether it be business or personal on a citywit.com site owned by the Seller for a specified duration and price as identified by the "Purchaser" at the time of purchase. Any renewed subscription is defined in the same terms.

Display Advertising: The purchase of an identified location (specific page and page location) on a citywit.com site, for a specified duration and price as identified by the "Purchaser" at the time of purchase.

Featured Listings: The purchase of a priority status for an item type and price identified by the "Purchaser" at the time of purchase. The "Seller" provides no guarantee, explicit or implied of results the "Purchaser" may receive by purchasing a featured listing. Furthermore, the "Seller" provides no guarantee, explicit or implied as to the featured listing order amongst other featured listings, only that featured listings are listed before non-featured listings.

REFUND POLICY

Customer satisfaction is a top priority and we strive to work with our customers in order to provide the best solution to any problem that may arise. The following process must be used when requesting a refund for a purchase made from a citywit.com site or the "Seller".

1. Send an email to customer.service@citywit.com with a subject of Refund Request and in the email body include contact information (address and phone number) and reason for requesting the refund.

2. Refund requests must be received by 12pm Mountain time for that same day to be considered as "unused".

3. CityWit staff will contact you to discuss the reason for the refund request.

4. If a refund is still required, the following policies will apply:

Refund Calculation: Refunds are pro-rated, for ALL purchases and only the amount of the unused portion of the purchase will be available for refunds.

For example, if $7 was paid to feature a classified ad for 7 days and the refund was requested by 12pm (Mountain Time) on the 3rd day of the ad being featured, then $5 would be the maximum possible refund (2 days out of the 7 were considered used).

Refund Payment: Refunds may be issued using the original card in which the purchase was made or by check, whichever is determined to be the most cost effective for the "Seller".

PRIVACY POLICY

The Seller's "Privacy Policy" is included as a part of this purchase agreement and can be found at http://citywit.com/Privacy.asp.

TERMS OF USE

The Seller's "Terms of Use" policy is included as a part of this purchase agreement and can be found at http://citywit.com/Terms.asp.

Termination and Agreement Components

citywit.com reserves the right, at its sole discretion, to pursue all of its legal remedies to delete your postings from this Site, to immediately terminate your registration with this Site if any of the Terms and Conditions are violated. In addition, if the Company is unable to verify or authenticate any information you submit to the Site your registration can be terminated.

Termination may occur without prior notice or liability and without refund for any purchase made on the site.

You will not misuse or share your username/password for citywit.com. If you are in violation of your obligations under the Terms and Conditions, your account may be subject to termination and/or you may be subject to prosecution.

Linking

The Site contains links to other World Wide Web Internet sites as a convenience to you. citywit.com is not responsible for the availability of these outside resources or their contents.
